Limlapp (“Limlapp”) is a technology platform (“Application”) that connects taxi drivers (“Driver”) and customers (“Customer”).

1. APPLICATION AND MEMBERSHIP

1.1. The Customer can start using the Application in accordance with these Terms of Use (“Terms”) by downloading the Application, filling in the sections required for registration, confirming the GSM number, and entering his password.
1.2. The customer accepts that all information provided during the application is always and in all respects complete, truthful and up-to-date. The Customer can always update their personal information through the Application. Exceptions set out in 4.2 are reserved.
1.3. The application is free to use.

2. USE OF THE APP

2.1. When the customer clicks on the taxi call button after registering with the Application and opening the Application, the taxi closest to his current location will be directed to him via the Application and if the Driver accepts the call; Driver and vehicle information are delivered to the Customer.
2.2. Limlapp does its best to make sure that the information given about the directed vehicle (estimated arrival time, distance of the vehicle to the Customer, etc.) reflects the truth. However, it cannot be held responsible for the fact that this information does not reflect 100% truth.
2.3. After this stage, the customer will be able to cancel the journey by pressing the cancel button on the screen.
For the first cancellation of the Passenger, a cancellation fee will be charged only in the following cases:

When the passenger presses the cancel button, (i) 90 seconds have passed since the driver accepted the call, (ii) when the call is cancelled, the driver has approached 750 meters as a bird flight, and (iii) the estimated arrival time when the cancel button is pressed. In the event that a maximum of 4 minutes has passed, a cancellation fee of 9 TL will be charged to the Passenger. This fee is 15 TL for black taxis.
When the driver presses the cancel button, a cancellation fee of 9 TL will be charged to the Passenger if (i) the Driver has waited for 2 minutes at a maximum distance of 100 meters from the Passenger's location and (ii) the Driver has approached at least 750 meters from the Passenger's location. . This fee is 15 TL for black taxis.
In addition to the above, the cases where the Passenger will be charged for the second and subsequent cancellations are as follows:

2.4. In cases where the driver does not come to the called address and does not approach the relevant location, no cancellation fee is charged from the Customer.
2.5. The customer can choose the option of the Driver to come by turning on the taximeter on the application. In this context, as soon as the Driver accepts the call, he will turn on the taximeter and set off towards the Customer's location. In addition to the "come with taxi meter" option for a trip, the customer can choose the "come with taxi meter" option, which will be valid for all trips. The customer will always be able to close this request through the Application. The customer cannot change his choice after the Driver accepts the call.

2.25. The Customer can report the Drivers that he has contacted and complained about through the Application to Limlapp from the complaints section within the Application. In this case, Limlapp makes necessary warnings to Drivers and may terminate business relations with drivers who repeat similar mistakes. However, Limlapp cannot be held responsible under any circumstances in connection with the behavior of Drivers, as the Application is a platform to bring Customers and Drivers together and to increase the quality and prevalence of taxi driving experience for interested parties.
2.24. The customer agrees not to take any action and/or action that could exploit the service offered by Limlapp for free.
2.25. Limlapp reserves the right to suspend the Customer's membership or remove it from the Application if it is determined that the Customer has violated the Terms.
2.26. Using the service provided by Limlapp, the Customer agrees to use the Application in accordance with the law and its purpose, and to be legally responsible for every transaction and action performed within the Application. Limlapp cannot be held responsible, directly or indirectly, for any transactions, actions and/or activities performed by the Customer through and/or within the Application, in violation of these Terms and the law.
2.27. Limlapp will not be held responsible for any of the Customer's inability to benefit from the service in the Application due to technical failures caused by the Customer, and for this reason, for failing to fulfill any of its obligations set forth in these Terms, and no claim can be made from it under any name.
2.28. The Customer agrees that Limlapp cannot be held responsible in any way, directly or indirectly, for any actions, actions and/or activities performed by the Driver and/or third parties, through and/or within the Application, in violation of these Terms and the law.
2.29. The Customer accepts that all responsibility for the security and storage of the system access tools (username, password, etc.) he uses in order to benefit from the services offered by Limlapp through the Application belongs to him.
2.30. The Customer shall not reproduce, copy, distribute pictures, texts, audiovisual images, video clips, files, databases, catalogs and lists within the Application, which may constitute an infringement of Limlapp and/or another third party's real or personal rights, assets, agrees that it will not work.
2.31. Limlapp may offer the Customer the opportunity to benefit from promotions or campaigns from time to time. In order to benefit from the relevant promotion/campaign, the Customer must comply with the terms of the promotion/campaign and must not engage in fraudulent acts (including fraudulently agreeing with Drivers to take advantage of the promotion/campaign, making misleading statements and creating false Customer profiles).
2.32. Limlapp may withdraw, suspend and/or terminate the Customer's access to the application in case the Customer violates the relevant campaign/promotion conditions and/or engages in fraudulent acts. In the event that the customer receives such notice from Limlapp, if he thinks that he has not violated the requirements of Article 2.30, he can appeal the relevant decision by contacting Limlapp Customer Service.

3. TERMINATION

The customer can terminate his Limlapp membership at any time, without giving any reason, by clicking the "Cancel Membership" button in My Account> My Information> Settings or by calling Limlapp customer service at 0850 333 4700. The customer can create up to 3 re-subscriptions with the GSM number defined for the canceled Limlapp membership.

4. PROTECTION OF PERSONAL DATA

4.2. The customer declares that (i) the information contained in the registration form is correct; (ii) Only one GSM number can be defined for each Customer created in Limlapp, (iii) can change the defined GSM number from Menu>My Account>Change Number, (iv) a new GSM number can only be defined if a new Customer is created on the Application, (v) accepts, declares and undertakes that he is personally responsible for any transaction he will make with his registered GSM number.

5. OTHER CONDITIONS

5.1. INTELLECTUAL PROPERTY RIGHTS

5.1.1. All elements of the application, including, but not limited to, design, text, images, html code and other codes (“Limlapp’s copyrighted works”) belong to Limlapp. Customer may not use Limlapp services, Limlapp information and copyrighted works of Limlapp for any commercial purpose. Customer may not reproduce, distribute or create derivative works from Limlapp's copyrighted works without the express written consent of Limlapp.
5.1.2. Limlapp; Limlapp services, Limlapp information, Limlapp copyrighted works, Limlapp trademarks, Limlapp commercial appearance, Limlapp business model or all of its property, real and personal rights, including any material and intellectual property rights, commercial information and know-how. 5.2. CONTRACT CHANGES

Limlapp may, at its sole discretion and unilaterally, change the Terms at any time it deems appropriate, by giving notice through the Application. The changed provisions of the Terms will become valid upon their on-line acceptance by the Customer through the Application, and the remaining provisions will remain in effect and continue to have their terms and consequences.

5.3. Force Majeure

Limlapp will not be held liable for late or incomplete performance or non-performance of any of its obligations in the Conditions in the event of a Force Majeure and during its duration, and therefore, no compensation can be claimed from Limlapp under any name. The term “force majeure”; including but not limited to natural disasters, riots, wars, strikes, communication problems, infrastructure and internet failures, power outages and bad weather; Events beyond Limlapp's reasonable control and which Limlapp could not prevent despite reasonable care will be interpreted as unavoidable events.

5.4. APPLICABLE LAW AND AUTHORITY

Turkish Law will be applied in the implementation, interpretation and legal relations arising under these Conditions and in case of any dispute arising or to arise within the scope of and/or in connection with these Conditions, Istanbul Central Courts and Enforcement Offices are authorized.

5.5. TERMINATION OF THE AGREEMENT

These Terms will remain in effect until the Customer's membership expires and will continue to have provisions and consequences between the Parties. Limlapp may unilaterally terminate the Terms in case the Customer violates the provisions set forth in these Terms or the rules and conditions contained in the Application.

5.6. VALIDITY OF Limlapp's RECORDINGS

The Customer, in disputes that may arise within the scope of these Terms, shall constitute reliable, binding, conclusive and exclusive evidence of electronic records and system records, commercial records, ledger records, microfilm, microfiche and computer records kept by Limlapp in its own database or servers; It accepts that it renders Limlapp free from the offer of oath and that this article is in the nature of an evidential contract within the meaning of Article 193 of the HMK.

5.7. FORCE

This Agreement has been mutually accepted and entered into force upon the electronic approval of the Customer.
